RENTING / BUYING PROPERTY IN PORTUGAL

OPENING A COMPANY IN PORTUGAL

Every Brazilian can do business in Portugal, without necessarily living in the Portuguese country. Opening a company in Portugal is one of the most sought after ways for Brazilians to be successful in the old continent. For those who wish to have their business in Portugal and still reside in the country, it is necessary to acquire a residence Visa, in this case the most indicated is the so-called D2. Initially, our lawyers identify what type of company is most appropriate for the client’s business. It can be a sole proprietorship, Limited or Private Limited Company, S.A., etc. We proceed with the opening of the company, opening of the bank account for the individual (natural person) and for the legal person (legal entity). We request the NIF (tax identification number), appoint a reliable accountant (bookkeeper), and gather all the company documents required for the visa application. In addition, we assist in the elaboration of the Business Plan, required for the acquisition of the D2 entrepreneur visa.

HOMOLOGATION OF FOREIGN JUDGEMENTS

The Homologation of Foreign Judgment is a mandatory procedure whenever it is necessary to make a Brazilian judgment valid in Portugal. Logically, you need to hire a lawyer registered in the Portuguese Bar Association to do this judicial procedure. The main cases are: divorce, stable union, adoption, paternity recognition, guardianship, curatorship.

TAXPAYER NUMBER ISSUE (NIF)

The NIF is the Tax Identification Number, also known as Número de Contribuinte in Portugal. It is equivalent to the CPF in Brazil, but used more frequently, even for supermarket purchases. With your fiscal number, in Portugal you will be able to start organizing your life in the country, open a bank account and rent a property. Moreover, you will be able to declare your income tax (very important for those who have children at school age, with the tax bracket, the parents will know how much they will pay the school). Therefore, the NIF is the first document you should make when living in Portugal, in the very first days after your arrival. 

FISCAL REPRESENTATION

The foreign citizen to request a NIF as a non-tax resident in Portugal must indicate a fiscal representative, which is nothing more than a Portuguese citizen or a foreign citizen with permanent residence in Portugal. The fiscal representative will be registered in the Portuguese Tax Authority system and any communication made by this entity will be sent to the fiscal representative’s address. You can count on our assistance to request your NIF. In some cases, we can also be your fiscal representative.

CERTIFICATE RECTIFICATION FOR PORTUGAL

To apply for Portuguese nationality, all the life certificates of your Portuguese ancestor must have the correct data. However, it is common to have some spelling mistakes, change of surnames or other information in the records made in Brazil, whether of marriage, death, etc. For this, it is necessary to Rectify the Certificate for Portugal.

ACADEMIC DEGREE VALIDATION

Degree equivalence is a process through which your Brazilian academic qualification will be compared to a Portuguese qualification. The academic degree validation will make your qualification valid for all legal purposes in Portugal, as if you had completed the course in the country. This evaluation and equivalence occurs in relation to the level (Licenciado, Master or Doctor), the duration of the course and the program content, and the scientific area of equivalence granted is also fixed.

SEARCHING FOR A CERTIFICATE IN PORTUGAL OR IN BRAZIL

The first step to acquire Portuguese Nationality, after knowing if you are entitled, is to have the Portuguese certificates of this ancestor. For that, it is necessary to conduct a certificate search in Portugal and even in Brazil and our office performs the search of all documents required to acquire Portuguese Nationality, both in Portugal and in Brazil. The search for these documents occurs mainly when one does not have a copy of the documents.

CITIZEN CARD AND PORTUGUESE OR BRAZILIAN PASSPORT

We schedule the interview in one of the Portuguese consulates in Brazil, inform (and gather) the necessary documents for you to go in person to the consulate. MARRIAGE TRANSCRIPTION

Marriage transcription is to inform Portugal that the Portuguese couple got married outside of Portugal. In other words, it is to update the information in the Portuguese birth certificate (to record the marriage). Only after this transcription, the applicant can start the process of Acquisition or Attribution of Portuguese Nationality. But not all cases require this procedure. Our office performs the Marriage Transcription, which is fundamental to start some dual citizenship processes.

DEATH TRANSCRIPTION

Death transcription is to inform Portugal that the Portuguese citizen died outside Portugal. That is, it is to update the information in the Portuguese birth certificate (to record the death). Only after this transcription, the applicant may start the process of Acquisition or Attribution of Portuguese Nationality. But not all cases require this procedure. Our office carries out the Transcription of Death, which is fundamental to start some dual citizenship processes.
